A seller wants a basement room advertised as a bedroom. The real estate professional cannot confirm whether it meets the applicable requirements. How should the room be marketed?
Incorrect. A seller's description does not verify that the room meets applicable requirements. Marketing must be accurate and supported by reliable information.
Correct! Only verified property features should be presented as fact. Neutral, accurate wording avoids making an unsupported claim while the room's status remains unconfirmed.
Incorrect. Uncertainty about one room does not require excluding the entire basement. Verified basement features can still be marketed accurately.
Incorrect. A direction to verify does not correct a potentially inaccurate advertising claim. The room's status should be confirmed before it is marketed as a bedroom.
Question 2 — Property Research · SLO 4.1.1.3
An MLS record states that a roof was replaced in 2019, but an invoice supplied by the seller is dated 2015. The seller cannot explain the difference. What should the real estate professional do?
Incorrect. An MLS entry is not automatically reliable because it is publicly available. Conflicting information must be investigated before either date is presented as fact.
Incorrect. An invoice is relevant evidence, but its date may reflect billing, repair or another event. The conflict should be investigated rather than resolved by assumption.
Correct! Conflicting property information should be checked against reliable sources. If the discrepancy cannot be resolved, the uncertainty must not be presented as a verified fact.
Incorrect. Removing the information avoids repeating an unsupported date but does not address the reliability issue. Reasonable verification should be attempted first.
Question 3 — Secondary Suites · SLO 4.2.1.11
A basement suite was lawfully established under an earlier land-use bylaw. Current zoning no longer permits new suites in that location, but the existing use has continued. How should the suite generally be classified?
Incorrect. A use does not become illegal solely because zoning rules later change. Its lawful status when established is an important part of the classification.
Correct! A previously lawful use that no longer conforms to current zoning may be legally non-conforming. This differs from a suite that was never lawfully established.
Incorrect. The earlier authorization may preserve the existing use, but it does not make the suite conform to the current zoning rules.
Incorrect. A zoning change does not automatically cancel a previously lawful use. The property's approvals, history and current municipal rules must be reviewed.
Question 4 — Comparative Market Analysis · SLO 4.3.2.3
A subject property has a renovated kitchen. An otherwise similar comparable has a dated kitchen. How should this difference generally be handled in the comparative market analysis?
Correct! Comparable properties are adjusted to reflect how they differ from the subject. An inferior feature generally requires an upward adjustment to the comparable.
Incorrect. A downward adjustment would make the inferior comparable appear less valuable and increase the difference. The adjustment should move its value toward the subject property.
Incorrect. In a comparative market analysis, adjustments are made to the comparable properties rather than to the subject property.
Incorrect. Comparable properties do not need to be identical. Relevant differences can be recognized through supported adjustments.
Question 5 — Transaction Conditions · SLO 5.4.1.3 and 5.4.1.4
A buyer's financing condition expires today, but the lender has not completed its approval. What should the buyer's real estate professional do?
Incorrect. Removing an unsatisfied financing condition may expose the buyer to significant contractual and financial risk. The condition should not be removed merely to keep the transaction moving.
Incorrect. Allowing the deadline to pass without instructions may jeopardize the buyer's protection or the transaction. The issue should be addressed before expiry.
Correct! The real estate professional should explain the available options and obtain the buyer's instructions before the deadline. Any extension must be requested and agreed to by the parties.
Incorrect. The seller may accept or reject a requested extension, but the buyer must decide how to proceed with their condition after receiving appropriate advice.
